Dear TASPA members,

The Texas Education Agency will conduct a stakeholder meeting on Monday, 02/25/2008 9:00 AM – 11:00 AM to solicit public comments and suggestions regarding developing implementation rules for the fingerprinting of contractors per SB 09.  If you have any questions or suggestions on this issue, please email me at amartin@taspa.org by NOON on Friday February 22 so I can compile your feedback for Monday's meeting.

The stakeholder meeting announcement, which was sent to association representatives and delineates the scope of the meeting, can be found here.

SB 09 can be found here , and reference to contractors is starting on page 10 of the PDF and ending at the top of page 13: Sec. 22.0834.  CRIMINAL HISTORY RECORD INFORMATION REVIEW OF CERTAIN CONTRACT EMPLOYEES.

TASPA President Elect Pamela Hall from Austin ISD and I will be there to represent TASPA, and we seek your input, questions, and suggestions on the following issues:

1) Andrew Allen, Assistant Counsel at SBEC, has a question for school personnel staff:  How and why do  you decide whether to treat a person as a part time or substitute employee or as a contract employee? That decision determines which part of SB 9 applies to their required criminal history.

2) How should TEA define "an entity that contracts with a school district"?  does  "contracts" include informal agreements?  Should the phrase include individuals, governmental agencies, non-profit associations with members rather than employees, subcontractors, and other entities that do not directly contract with a school entity?

3) How should "continuing duties with respect to the contracted services" be defined?

4) How should "direct contact with students," be defined?
